Spousal Support
Is Spousal Support the Same as Alimony?
Labled alimony in the past, this term has now been changed to spousal support. Spousal support is money or property that is paid by one party in a divorce to the other and intended to pay for that party's expenses including maintaining the living standing of that party, their health, education, and welfare.

Eligibility Considerations
In general, Michigan courts try to find an equitable solution that is fair to both parties. Courts consider many things when determining whether to award spousal support. Some of these factors include how the parties conducted themselves during the marriage; the ability of the parties to work and earn a living; how long the parties were married; the extent of the property settlement; the age, health, and needs of each of the parties; the educational level of each party; the ability of the parties to pay spousal support; the standard of living that existed during the marriage; and the present situation of the parties. And even though Michigan is a no-fault divorce state, the court may look into the reasons for the divorce.

How Much Will the Court Award?
Unlike child support, there is no actual formula to determine the amount of spousal support that one of the parties to the divorce will receive. The court often times however, will look at the same factors listed above when making this determination. The court will also consider who is the custodial parent and that parent's ability to work and care for the children.

How Long Can I Receive Spousal Support?
The court has the discretion to determine how long spousal support will last. Spousal support may be awarded for a fixed length of time. Or it may order spousal for a fixed length of time with a review scheduled to determine whether the support should be extended or terminated. I some case, the court may order the spousal support continue indefinitely, ending only on the death of one of the parties, remarriage, or for certain other reasons.
