Understand the Deal or Know the Law

Before you accept a deal from the Prosecutor, make sure you understand what the implications are.
Often times if you are charged with a crime, the Prosecutor may offer you a deal to get this quickly of his or her docket or to keep it from going to trial adding expense and time to the Prosecutor's case against you. But before you agree make sure you understand what you are doing. The best thing is to have an experienced attorney who understands the law on your side to help you with your decision.

Don't let this happen to you
A new client of mine was a passenger in a car that was pulled over for making an illegal turn. When the officer was speaking to the driver, he observed a baggie with a small amount of marijuana sticking out of my client's purse. He asked if it was illegal drugs to which she replied it was and handed the bag to him. Thinking he was doing my client a favor he wrote her up for Possession of Drug Paraphernalia which is illegal under the local ordinances in the city where the car was stopped.

When she went to court, she appeared before the local magistrate for arraignment. She was told that if she pleaded guilty to the charge, that she would be fined and that would end the matter. What she did not know was that Possession of Drug Paraphernalia is a misdemeanor, it would appear on her criminal record. On the other hand, had she demanded that she be charged with what she actually did, possess marijuana, she would have been eligible for a diversion program, she would have put on probation for a year but after that year, the charge would have been dismissed and should could continue to say that she had never been arrested. You see under Michigan Law, possessing Drug Paraphernalia is not illegal, only selling it is. It is, however, illegal under many city ordinances and there is no diversion program available for offenders.

Unfortunately, without an attorney, this client made the wrong choice. She realized this after applying for several jobs. While initially receiving favorable responses, prospective employers would call back to say that they could not hire her because she had a drug related conviction.
