Detroit & Michigan Felon in Possession Defense Lawyer and Attorney
If you are charged with being a Felon in Possession, you may be facing 5 years in prison. James Schmier, an experienced and aggressive Criminal Defense Attorney will fight to protect your freedom.

If You are A Felon, You Cannot Possess a Firearm
Under Michigan law, an individual convicted of a felony is, by law, prohibited from possessing a gun. Possession can be both actual or constructive. Actual possession means that the accused actually possessed the firearm. For instance, he had the firearm in his hand. Constructive possession means that while the accused did not have the gun in his actual possession, he knew where the gun was and could have actually possessed the firearm if he or she desired to do so.

Even if the gun doesn’t work or is not loaded, you can still be convicted of felony firearm
In Michigan, you can be convicted of felon in possession if the gun was locked in your basement, but you had the key. Even if the firearm is inoperable, does not have bullets, or you are just using it to hunt deer or ducks, you could still be charged and convicted.

Consequences of a Felon in Possession Conviction:
If you are convicted of felon in possession charges, you could be sentenced to a long prison term of up to five years. While the law prohibits felons from possessing a firearm, depending on the felony charge, there are procedures that will allow you to once again exercise your constitutional rights and own a gun. Our office knows the law and can help you restore your right to gun ownership.
