Penalties for a first-time drunk driver with a BAC of .17 or higher are enhanced.

Michigan's "Super Drunk" Laws

The law in regard to first time drunk drivers will change this October 31st. Beginning on that date, if your BAC or blood alcohol content is greater than .17, you will face enhanced penalties. These enhanced penalties do not apply to 2nd or multiple offenders because those penalties currently, are even higher than the new laws that only effect first-time offenders.

Penalties for DUI Drunk Driving with a BAC greater than .17

The new law imposes a one-year substance abuse treatment requirement. In addition, fines are increased and offenders face up to 180 days in jail instead of up to 93 days. The Secretary of State office will suspend driving privileges for one-year, the first 45 days being a "hard" suspension (meaning no driving) with the offender being entitled to a restricted license with installation of a breath alcohol ignition interlock device (BAIID) at the offender's expense. In addition to the installation fee, monitoring fees could be as high as $100 per month.

Multiple Offenders and BAIID

The new law also provides that multiple offenders who have had their driver's licenses revoked may only have a restricted license for one year with the required installation of a BAIID. The device can then only be removed through an order issued by the Secretary of State. There are also penalties and vehicle impoundment for driving a vehicle not equipped with a BAIID and penalties for attempting to drive with a BAC greater than .025.
